Welcome to Thespian Arts Academy! These terms and conditions govern your use of our website and enrollment in our acting courses offered in New York City. By accessing our website, enrolling in a course, or using any of our services, you agree to be bound by these terms. Please read them carefully. If you do not agree with any part of these terms, you should not use our website or enroll in our courses.
1. Account Terms
To enroll in courses at Thespian Arts Academy, you may be required to create an account. You are responsible for maintaining the confidentiality of your account information, including your username and password. You agree to notify us immediately of any unauthorized access to or use of your account. Thespian Arts Academy will not be liable for any loss or damage arising from your failure to protect your account information.
- You must be at least 18 years old to create an account and enroll in courses. If you are under 18, you must have the consent of a parent or legal guardian.
- You agree to provide accurate and complete information when creating your account and enrolling in courses.
- We reserve the right to suspend or terminate your account if you violate these terms and conditions.
- Your account is personal to you and you may not transfer your account to another person.

2. Payment Terms
Payment for courses at Thespian Arts Academy is due at the time of enrollment, unless otherwise specified. We accept various forms of payment, including credit cards, debit cards, and online payment platforms. All payments are processed securely through a third-party payment processor.
- Course fees are non-refundable, except as outlined in our refund policy.
- Late payments may be subject to a late fee.
- We reserve the right to change our course fees at any time, but changes will not affect courses you have already enrolled in.
- If a payment is declined, we will notify you and you will have a specified period to resolve the issue. Failure to resolve the payment issue may result in your removal from the course.
- We may offer payment plans for certain courses. The terms of the payment plan will be outlined at the time of enrollment.
3. Course Access
Upon enrollment and payment of course fees, you will be granted access to the course materials and classes. Access to course materials may be limited to the duration of the course. Thespian Arts Academy reserves the right to modify or discontinue courses at any time, but we will provide reasonable notice to enrolled students.
- You are responsible for ensuring that you have the necessary equipment and internet access to participate in the course.
- Course materials are for your personal use only and may not be shared or distributed without our permission.
- We reserve the right to remove students from a course if they violate our code of conduct or disrupt the learning environment.
- Attendance is expected for all classes. Excessive absences may affect your ability to complete the course.
- Access to online resources may be terminated if you violate these terms and conditions.
4. Intellectual Property
All content on the Thespian Arts Academy website, including text, graphics, logos, images, and course materials, is the property of Thespian Arts Academy or its licensors and is protected by copyright and other intellectual property laws. You may not use, reproduce, or distribute any content from our website or courses without our express written permission.
- You retain ownership of any original work you create as part of a course, but you grant Thespian Arts Academy a non-exclusive license to use your work for promotional purposes.
- You agree not to infringe on the intellectual property rights of others while participating in our courses.
- We reserve the right to remove any content that violates our intellectual property policy.
- Any feedback or suggestions you provide to Thespian Arts Academy may be used by us without any obligation to compensate you.
- The Thespian Arts Academy logo and name are trademarks of Thespian Arts Academy and may not be used without our permission.
5. Limitation of Liability
To the fullest extent permitted by law, Thespian Arts Academy shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in any way connected with your use of our website or enrollment in our courses, including, but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising out of these terms and conditions shall not exceed the amount you paid for the course in question.
Specifically, while our instructors, such as renowned acting coach Vivian Holloway, strive to provide the highest quality instruction and guidance, Thespian Arts Academy does not guarantee employment or success in the acting industry upon completion of any course. The acting field is highly competitive, and individual success depends on a variety of factors beyond the control of the Academy.
- We are not responsible for any injuries that may occur during in-person classes, unless caused by our negligence.
- We are not responsible for any technical issues that may disrupt your access to online resources.
- We are not responsible for the actions or conduct of other students or instructors.
- This limitation of liability applies to all claims, regardless of the legal theory on which they are based.
- You agree to indemnify and hold harmless Thespian Arts Academy from any claims arising out of your breach of these terms and conditions.
6. Governing Law
These terms and conditions shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles. Any dispute arising out of or relating to these terms and conditions shall be subject to the exclusive jurisdiction of the state and federal courts located in New York City.
